TERMS & CONDITIONS
These Terms & Conditions govern all purchases and use of Rugged Design Concepts (“RDC”) products and services. By purchasing, installing, or using any RDC product, you acknowledge and agree to the following terms.
1. Product Use & Assumption of Risk
Rugged Design Concepts manufactures premium aftermarket products designed for adventure, utility, and off-road performance. While engineered with precision and tested for durability, aftermarket modifications inherently alter a vehicle’s performance and may introduce risks.
By installing or using RDC products, you acknowledge and accept full responsibility for:
-
The safe operation of your vehicle.
-
The impact of modifications on vehicle handling, performance, or manufacturer warranties.
-
Any risks associated with off-road driving, heavy loading, or extreme use.
RDC shall not be held liable for accidents, injuries, or damages resulting from collisions, rollovers, off-road use, overloading, competition, or negligent operation.
2. Transfer of Title & Risk of Loss
All deliveries are made EXW (Ex Works) – Hesperia, California or other RDC shipping point. Title and risk of loss transfer to the customer upon delivery of the product to the carrier. RDC is not responsible for freight damage, delays, or loss once products leave our facility. Claims for shipping damage must be filed directly with the carrier.
3. Installation & Workmanship
-
Professional installation is required for warranty coverage.
-
Where installation services are provided directly by RDC, workmanship is covered under a 12-month limited warranty.
-
RDC is not responsible for issues arising from self-installation, improper installation, or installation performed by non-approved third parties.
4. Third-Party Products
Products not manufactured by RDC (such as lighting, awnings, or accessories) are covered exclusively by their original manufacturer warranties. RDC assumes no liability for performance, defects, or failures of third-party products, even when sold in conjunction with RDC products.
5. Warranty Reference
RDC’s Limited Warranty Policy applies exclusively to defects in materials and workmanship under normal use, as outlined on our Warranty page. Custom or bespoke commissions are final sale and excluded from return, exchange, or warranty.
6. Limitations of Liability
To the fullest extent permitted by law:
-
RDC’s liability is limited to the original purchase price of the product.
-
RDC is not liable for incidental, indirect, special, or consequential damages, including but not limited to vehicle downtime, labor costs, or loss of use.
-
Aftermarket modifications may void original equipment manufacturer (OEM) warranties. Customers assume full responsibility for determining and accepting these impacts.
7. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of the State of California. Any disputes shall be resolved exclusively through binding arbitration in San Bernardino County, California.
8. Compliance & Safety
-
RDC products are not crash-tested or certified to federal or international safety standards.
-
Customers are responsible for ensuring compliance with local vehicle registration, inspection, or modification regulations.
-
RDC disclaims liability for vehicle performance or safety system impacts resulting from aftermarket modifications.
9. Prop 65 Warning (California Residents)
Some RDC products may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.
10. Intellectual Property
All designs, logos, product names, photography, and written content remain the intellectual property of Rugged Design Concepts. No content may be copied, reproduced, or distributed without prior written permission.
11. Cancellation & Processing Fees
Due to the high cost of payment processing on custom orders, RDC reserves the right to apply a 5% cancellation fee on orders over $500 if canceled after processing. Custom or bespoke orders are non-refundable once work has begun.
12. Purchases Through Authorized Resellers or Builders
Rugged Design Concepts products may be purchased through authorized resellers, builders, or upfitters. In such cases:
-
Warranty coverage remains valid only if the reseller or builder is authorized by RDC.
-
The reseller or builder is the first point of contact for warranty claims, installations, or service issues.
-
Rugged Design Concepts is not responsible for installation errors, damages, or modifications performed by third-party builders, whether or not they are authorized resellers.
-
Liability for workmanship, installation, or integration with other vehicle systems rests solely with the builder or reseller.
RDC reserves the right to request proof of purchase and confirmation that the product was sold through an authorized reseller to validate warranty claims.
13. Acceptance of Terms
By purchasing, installing, or using Rugged Design Concepts products, you confirm acceptance of these Terms & Conditions and release Rugged Design Concepts from liability beyond the limits set forth herein.
